RCM Digital Media LLC provides the following services to businesses across the United States, with primary focus on a 7-state Midwest territory (Ohio, Pennsylvania, West Virginia, Kentucky, Indiana, Michigan, and Tennessee):

• Titan Phoenix: A proprietary self-learning AI marketing system that autonomously manages campaigns, content creation, ad placement, and performance optimization across multiple platforms.
• Titan Global Connector: A proprietary payment orchestration system providing multi-rail payment routing, intelligent retry logic, and cross-border payment optimization.
• AI Marketing Strategy & Consulting: Custom AI automation strategy, implementation, and management services tailored to individual business needs.
• Digital Marketing Services: Including SEO, paid advertising, social media management, content marketing, email campaigns, funnel development, and CRM setup.
• Reputation Management: Monitoring, response management, and brand protection services.
• n8n Workflow Automation: Enterprise-grade automation workflows built on dedicated client infrastructure.
• Free AI Audit Consultations: Strategy calls to assess current marketing performance and identify areas for improvement.

Specific deliverables, timelines, and pricing are outlined in individual service agreements or proposals provided to each client. These Terms & Conditions serve as the foundational agreement governing all engagements.

RCM Digital Media LLC owns and protects the following proprietary technologies, which are protected under provisional patents filed with the United States Patent and Trademark Office (USPTO) in December 2025:

• Your Content: You retain full ownership of all content, logos, images, and materials you provide to us.
• Our Work Product: Upon receipt of full payment, you receive a license to use deliverables created for your account. RCM Digital Media LLC retains the right to display completed work in our portfolio unless otherwise agreed in writing.
• Our Proprietary Systems: Proprietary systems, workflows, automations, templates, AI models, and software developed by RCM Digital Media LLC — including Titan Phoenix and Titan Global Connector — remain our exclusive intellectual property and are licensed to you, not sold.
• Protected Names: The names "Titan Phoenix," "Titan Global Connector," "Tripartite AI Brain," and "RCM Digital Media" are proprietary names of RCM Digital Media LLC and may not be used without written permission.
• No Reverse Engineering: Unauthorized use, replication, or reverse engineering of any RCM Digital Media system or technology will be pursued to the fullest extent of the law.

RCM Digital Media LLC provides AI-powered marketing and automation services. By engaging these services, you acknowledge and agree to the following:

• AI Output Accuracy: While our systems are built with enterprise-grade safety protocols including dual-gate compliance checks, AI-generated content and recommendations are not guaranteed to be error-free. Human oversight is maintained and clients are encouraged to review all AI-generated materials prior to publication.
• Performance Results: Marketing results vary based on industry, market conditions, budget, competition, and numerous other factors outside our control. RCM Digital Media LLC does not guarantee specific revenue outcomes, conversion rates, or return on investment figures.
• Data Usage: AI systems require access to client business data, campaign history, and performance metrics to function effectively. All client data is maintained in Dedicated Client Environments (DCEs) — isolated Docker containers with zero cross-contamination between clients.
• Third-Party AI Models: Our Titan Phoenix system utilizes multiple AI models including Google Gemini, Meta LLaMA4, OpenAI GPT, and Anthropic Claude. Use of these services is also subject to their respective terms of service.
• Third-Party Platforms: Our services may involve GoHighLevel, Google, Meta, and other platforms. You are subject to those platforms' own terms of service. We are not responsible for changes to third-party platforms that affect service delivery.
• System Availability: While we maintain 99.9% uptime targets on Google Cloud infrastructure, we do not guarantee uninterrupted service and are not liable for damages resulting from service interruptions beyond our control.

To ensure effective service delivery, you agree to:

• Provide accurate and complete business information required to deliver services.
• Respond to requests for content, approvals, or feedback within agreed timelines.
• Ensure you have full rights to any materials — logos, images, copy, data — that you provide to us.
• Comply with all applicable laws regarding your business, marketing practices, and industry regulations.
• Not use our services for any illegal, fraudulent, deceptive, or harmful purposes.
• Maintain confidentiality of any proprietary system access, credentials, or methodologies shared with you.

• Due Dates: All fees are due as specified in your service agreement. Monthly retainer services are billed in advance.
• Payment Methods: We accept Visa, Mastercard, ACH transfer, Stripe, and other methods specified at checkout or in your service agreement.
• Late Payments: Invoices unpaid after 15 days may result in service suspension. Accounts 60 or more days past due are subject to a 1.5% monthly late fee and potential termination of services.
• Payment Routing: Our Titan Global Connector technology may route payments through multiple payment rails to optimize processing. All routing is conducted securely and in compliance with applicable payment processing regulations.
• Chargebacks: Fraudulent chargebacks will be disputed. RCM Digital Media LLC reserves the right to pursue recovery of fraudulent chargeback amounts plus all associated fees and legal costs.

• Setup Fees: Non-refundable once project kickoff has occurred and work has commenced.
• Monthly Services: You may cancel at any time with 30 days written notice. No refunds are issued for the current billing period. Service continues through the end of the paid period.
• Custom Projects: Refunds are evaluated on a case-by-case basis based on the percentage of work completed at the time of cancellation request.
• AI & Automation Services: Due to the nature of AI system development and deployment, fees paid for completed development work are non-refundable. Disputes must be raised in writing within 14 days of service delivery.

Both parties agree to keep confidential any proprietary business information shared during the course of the engagement. This obligation survives termination of the service agreement. RCM Digital Media LLC's data security architecture includes:

• Dedicated Client Environments (DCEs): Every client's data and AI learning is maintained in isolated Docker containers. There is zero cross-contamination between client data sets.
• Data Isolation: Our architecture explicitly prevents model inversion and data bleed. Your proprietary business intelligence remains strictly yours.
• Google Cloud Security: All systems run on Google Cloud Platform with enterprise-grade SOC-2 architecture and end-to-end encryption.
• Data Retention: Client data is retained for the duration of the service agreement plus 90 days. Upon written request, client data will be permanently deleted within 30 days of contract termination.

Digital marketing and AI automation results vary based on industry, market conditions, competition, budget, and client participation. RCM Digital Media LLC does not guarantee specific revenue outcomes, lead volumes, conversion rates, or ROI.

To the maximum extent permitted by applicable law, RCM Digital Media LLC shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.
• Loss of revenue, profits, data, or business opportunities arising from service interruptions or AI system outputs.
• Damages resulting from third-party platform changes — including Meta, Google, GoHighLevel, TikTok, LinkedIn, or others — that affect campaign performance or service delivery.
• Results not achieved due to factors outside our control including market conditions, client inaction, or platform policy changes.
• Any errors in AI-generated content that has been reviewed and approved by the client prior to publication.

Either party may terminate services with 30 days written notice unless otherwise specified in an individual service contract. RCM Digital Media LLC reserves the right to terminate immediately and without notice if:

• Payment is 60 or more days past due.
• The client requests use of our systems for illegal, fraudulent, or deceptive activities.
• The client engages in conduct that is abusive, fraudulent, or harmful to our team or reputation.
• Continuing the relationship would require RCM Digital Media LLC to violate applicable laws or regulations.
• The client violates these Terms & Conditions or any applicable laws.

Upon termination, all access to RCM Digital Media systems will be revoked within 48 hours. Client data will be returned or deleted per the terms outlined in Section 08.

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of our services shall be resolved in the state and federal courts located in Clark County, Ohio. For clients outside Ohio, you agree to submit to Ohio jurisdiction for any legal proceedings.

RCM Digital Media LLC reserves the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated terms.

For active clients, material changes will be communicated via email with 14 days notice before taking effect.
